Cpl. Jacob Foster, officer Heidi Custodio and officer Travis Harwood responded to the area between North Park Quads (NPQ) Building 1 and the Living Learning Community (LLC) buildings, in reference to a domestic disturbance.
Upon arrival, the officers were unable to locate the disturbance. Around 10:22 p.m., Sgt. Jeremy Oswalt, Foster, Custodio and Harwood were dispatched to Kays Hall in reference to a domestic disturbance in progress.
They met with the victim and learned that she and her boyfriend, the arrestee, were the subjects of the aforementioned call.
The victim said she and the arrestee were in his room at NPQ Building 1, when they got into an argument over conversations on her iPad from over a year ago with another male.
The victim said the arrestee started calling her derogatory names and she left the room to get away from the situation. However, the arrestee followed her outside.
During the course of this argument, the arrestee took the victim’s cell phone and threw it to the ground causing it to break.
The victim then proceeded to walk to her residence located at Kay’s Hall and the arrestee continued to follow her. The victim said she told the arrestee multiple times to leave her alone and that she did not want him to come to her room.
The victim said he would not quit following her and continued to tell her that he was going to come to her room. The victim said while in the elevator, they continued to argue and the arrestee told her he would “break her face”.
Upon arrival at the victim’s room, she repeated to the arrestee she does not want him in her room. Upon unlocking her door, the arrestee pushed her to the side and entered her room.
The victim said she attempted to push the arrestee out of her room and at this time he started to push her and grabbed her by her hooded sweatshirt and started to “sling” her around.
The victim said she then told the arrestee she was going to go to the Resident Advisor (RA) to have them call the police. The arrestee blocked her exit and refused to allow her to leave.
After a few moments of the arrestee pushing her, she was finally able to get out of her room, where she proceeded to go to the RA’s desk and call University Police.
At this time, the arrestee left the scene and the RA on duty changed the victim’s room for safety reasons.
Oswalt said he also provided the victim with a Laura’s Card and advised her of her victim’s rights and a lethality screening was completed.
Around 10:58 p.m., Foster, Custodio and Harwood located the arrestee at NPQ Building 1, and took him into custody, transporting him to the University Police Department to be interviewed.
Around 11:40 p.m., Oswalt read the arrestee his Miranda Rights, to which he said he understood and signed the form from which they were read.
The arrestee told Oswalt he did not wish to speak to him. He was then arrested and transported to Craighead County Jail by officer Custodio and officer Harwood for residential burglary and assault on family or household member. The arrestee was also banned from returning to Kay’s Hall.
The arrestee does not have any prior criminal history according to NCIC/ACIC.
